1. Acceptance of Terms

By requesting or authorizing any service from Spinin' Wrenches ("we," "us," "the shop"), located at 33202 Octavia Dr, Magnolia, TX 77354, you ("customer," "you") agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

• You must be at least 18 years of age or have a parent/guardian authorize work on your behalf.
• We reserve the right to refuse service to anyone at our sole discretion.
• While we strive for accurate pricing, pricing errors do not obligate us to perform work at an incorrect price. We will notify you of any corrections before proceeding.

2. Repair Services

We specialize in powersport vehicle repair and maintenance, including but not limited to:

• Motorcycles — Harley-Davidson, American V-Twin, metric cruisers, sport bikes, touring
• ATVs & UTVs — four-wheelers, side-by-sides, utility vehicles
• Dirt Bikes — off-road, motocross, trail bikes
• Jet Skis & Personal Watercraft — Sea-Doo, Yamaha WaveRunner, Kawasaki Jet Ski, jet pump overhauls, motor rebuilds

Service availability depends on parts, scheduling, and vehicle condition. We reserve the right to decline work on any vehicle we determine is beyond economical repair or outside our scope of expertise.

3. Estimates & Authorization

• Estimates may be provided verbally or in writing. Verbal estimates are given in good faith but are not guaranteed. Written estimates are valid for 30 days from the date issued.
• You must authorize all work before we begin. Authorization may be given in person, by phone, text, or email.
• If during the course of repair we discover additional issues, we will contact you for approval before performing any work beyond the original scope. Additional parts and labor will be quoted separately.
• You have the right to decline additional work. However, if additional issues affect the safety or function of the original repair, we will advise you of the risks before returning the vehicle.
• A diagnostic or teardown fee may apply if you decline the recommended repair after disassembly has begun.

4. Parts & Materials

• We may use OEM (Original Equipment Manufacturer) or quality aftermarket parts depending on availability, cost, and customer preference. We will discuss options when applicable.
• If you choose to supply your own parts ("customer-supplied parts"), installation is performed at your own risk. We cannot guarantee fitment, quality, or longevity of parts we did not source.
• No warranty is provided on customer-supplied parts, and additional labor charges may apply if customer-supplied parts fail, do not fit, or cause complications during installation.
• Replaced parts become the property of the shop unless you request their return at the time of authorization.

5. Payments & Refunds

• Full payment is due upon pickup of the vehicle. We accept cash, credit/debit cards, and other posted payment methods.
• We reserve the right to hold your vehicle until payment is received in full (mechanic's lien under Texas law).
• Storage fees of $15/day may be assessed on vehicles not picked up within 30 days of notification that work is complete.
• Vehicles not claimed within 90 days of completed work and customer notification may be considered abandoned under Texas Transportation Code, Chapter 683 (Abandoned Motor Vehicles), and we may pursue legal remedies including disposal or sale.
• Labor is non-refundable once work has been performed. Refunds on parts are handled on a case-by-case basis and may be subject to restocking fees.

6. Vehicle Storage & Abandonment

• Vehicles left at our facility are stored at the owner's risk. While we take reasonable precautions, we are not responsible for theft, vandalism, fire, weather damage, or Acts of God affecting stored vehicles.
• We are not an insured storage facility. Your vehicle insurance should cover your machine at all times, including while it is in our possession.
• Under Texas abandoned vehicle law, if you fail to reclaim your vehicle and do not respond to our written notice, we may take legal steps to have the vehicle declared abandoned and disposed of or sold to recover outstanding charges.

7. Warranty

• We provide a 30-day warranty on labor from the date of pickup, covering defects in workmanship under normal use conditions.
• Parts sourced by us carry the manufacturer's warranty, if any. We will assist with warranty claims on parts we supplied.
• Warranty is void if the vehicle is modified, tampered with, or repaired by another party after leaving our shop.
• No warranty is provided on customer-supplied parts, used parts, or repairs performed on vehicles with pre-existing damage or known mechanical deficiencies.
• Warranty does not cover normal wear and tear, abuse, neglect, racing, or improper operation of the vehicle.

8. Limitation of Liability

• All services are provided "AS IS" to the fullest extent permitted by law.
• Our total liability for any claim arising from our services shall not exceed the lesser of $50 or the amount paid for the specific service giving rise to the claim, within a 12-month period.
• We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of income, towing costs, rental expenses, or emotional distress.
• We are not responsible for pre-existing conditions, undisclosed damage, or mechanical issues that existed before the vehicle was brought to us.
• All claims must be brought within one (1) year of the date of service. Any claim not brought within this period is permanently barred.
• We are not liable for delays or failures caused by force majeure events, including natural disasters, pandemics, supply chain disruptions, government actions, or other circumstances beyond our reasonable control.

9. Premises Safety

Our shop is an active repair facility. By entering the premises, you acknowledge the following hazards and accept responsibility for your own safety:

• Hot surfaces — engines, exhaust components, and welding equipment may be extremely hot.
• Tools and equipment — power tools, pneumatic tools, and hand tools are in active use throughout the shop.
• Chemicals — solvents, fuels, oils, brake fluid, coolant, and cleaning agents are present and may be hazardous.
• Vehicle lifts and jacks — vehicles may be elevated on lifts or supported by jacks.
• Moving vehicles — motorcycles, ATVs, and other vehicles may be moved through the shop at any time.
• Sharp edges — metal parts, frames, and components may have sharp or rough edges.
• Children must be supervised at all times. The shop floor is not a safe environment for unattended children.
• We are not responsible for personal property (including items left in or on your vehicle) that is lost, stolen, or damaged while on our premises.
• Video surveillance may be in use on the premises for security purposes. By entering, you consent to being recorded.
• Please provide 48 hours' notice if you intend to visit the shop to observe work on your vehicle, so we can ensure a safe viewing area.

10. Indemnification

You agree to indemnify, defend, and hold harmless Spinin' Wrenches, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising out of or related to:

• The condition of your vehicle, including pre-existing defects, undisclosed modifications, or unsafe conditions.
• Your negligence or misconduct while on our premises or in connection with the services provided.
• Any third-party claims arising from your use of the vehicle after service.

This indemnification obligation survives termination of the service relationship.

11. Waiver of Claims

By authorizing services, you voluntarily waive and release Spinin' Wrenches, its owners, employees, and agents from any and all claims, demands, actions, or causes of action, whether known or unknown, that arise from or relate to services performed on your vehicle.

This waiver is broad and intended to be a complete release to the fullest extent permitted by Texas law. It is binding upon you, your heirs, executors, administrators, and assigns.

12. Dispute Resolution

• These Terms are governed by the laws of the State of Texas. Any dispute shall be resolved in the courts of Montgomery County, Texas.
• Before filing any claim, you agree to attempt informal resolution by contacting us directly. We commit to making a good-faith effort to resolve any issue within 30 days.
• If informal resolution fails, disputes shall be resolved through binding arbitration administered by a mutually agreed-upon arbitrator in Montgomery County, Texas, in accordance with Texas arbitration rules.
• You waive the right to a jury trial and to participate in any class action or collective proceeding.
• The prevailing party in any dispute shall be entitled to recover reasonable attorney's fees and costs.

13. Privacy

We collect only the information necessary to perform services on your vehicle (name, contact info, vehicle details). Your information is used solely for service-related communication and record-keeping.

We will never sell, trade, or share your personal data with third parties for marketing purposes. Period.

14. General Provisions

• Severability: If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and Spinin' Wrenches regarding the services described, superseding any prior agreements or understandings.
• No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
• Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights without our written permission.
• Changes to Terms: We reserve the right to update these Terms at any time. Changes are effective immediately upon posting to this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
